Terms of Service

These terms and conditions govern the access or use by you of applications, websites, services and contents made available by CHEQIT Innovations (Pty) Ltd ("the Company"), a private company established in Johannesburg, South Africa, with Registration Number: (2023/268134/07).
By registering for an account and ticking the "I agree to the Terms and Conditions and Privacy Policy" box during the sign-up process, your access and use of the Services constitutes your agreement to be bound by these Terms.
CHEQIT may amend these Terms and Conditions as needed. For any material changes to these Terms, we will provide you with at least 14 days' notice before the changes take effect.
The services involve a technology platform that enables users of CHEQIT mobile applications and websites to arrange and schedule reservations, place orders in store, send out invoices, as well as enterprise systems provided to merchants.
You acknowledge that CHEQIT Innovations (Pty) Ltd provides the CHEQIT technology platform to connect users with Third Party Providers (Merchants). CHEQIT Innovations (Pty) Ltd does not itself provide the goods or services offered by these Merchants and is not an agent for them.
Ownership:
The Services and all rights therein are and shall remain the property of CHEQIT Innovations (Pty) Ltd or the property of its licensors. The intellectual property for the CHEQIT platform is owned by our licensor, Terinit Technologies (Pty) Ltd.
The service is not available for use by people under the age of 18. You must register for and maintain an active personal user account with accurate, complete, and up-to-date information.
Prohibited conduct includes, but is not limited to: creating fraudulent reviews, misusing promotional codes, engaging in abusive or hateful communication with Merchants or other users, and attempting to circumvent the platform's payment system.
You may be asked for proof of identity or age and you agree that you may be denied access to or use of the services if you refuse to provide such proof.
You understand that the use of the Services may result in charges to you for the services or goods you receive from a Third Party Provider ("Charges"). After you have received the services or goods, CHEQIT will facilitate your payment of the applicable Charges on behalf of the Third Party Provider.
Charges paid by you are final and non-refundable. However, this provision does not affect your statutory rights. Refund requests for goods or services that were not rendered or did not meet the required standards should be directed to the Third Party Provider (Merchant) in accordance with their policies and the Consumer Protection Act.
All Charges are due immediately and payment will be facilitated by CHEQIT based on the preferred payment method designated in your account.
The Services Are Provided "As Is" And "As Available." CHEQIT Disclaims All Representations And Warranties, Express, Implied Or Statutory, Not Expressly Set Out In These Terms and Conditions.
CHEQIT Will Not Be Liable For Indirect, Incidental, Special, Exemplary, Punitive Or Consequential Damages, Including Lost Profits, Lost Data, Personal Injury Or Property Damage Related To, In Connection With, Or Otherwise Resulting From Any Use Of The Services.
The limitations and disclaimers in this section do not purport to limit liability or alter your rights as a consumer that cannot be excluded under applicable law, including the Consumer Protection Act, 68 of 2008.
In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms, the parties shall first use their best efforts to settle the dispute. A party may send a written notice to the other describing the facts and circumstances of the dispute and allowing the receiving party 15 days in which to respond or settle the dispute.
If the parties do not reach a solution within a period of 30 days, then upon notice by either party to the other, all disputes shall be finally settled by arbitration administered by the Arbitration Foundation of Southern Africa (AFSA) in accordance with its rules.
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. You hereby consent to the exclusive jurisdiction of the High Court of South Africa, Gauteng Local Division, Johannesburg, in respect of any disputes arising in connection with the services.
